Arrested For DUI - Avoiding A License Suspension

Police traffic stop

Facing a DUI charge is an overwhelming experience that can leave you uncertain about the future consequences. Knowing the next steps you should take can significantly impact the outcome of your case. Regardless of whether it's your first or second DUI, you should always contact a lawyer to help navigate the legal system.

Contacting A Lawyer

After being arrested for DUI, you should contact a lawyer as soon as possible. Finding a lawyer who specializes in DUI defense is crucial for improving your chances of a favorable outcome. Contacting a lawyer can provide you with important information on navigating the legal system and avoiding a driver's license suspension.

Contacting The DOL

If you're arrested for DUI, the Department of Licensing will suspend your driver's license unless you request a hearing to contest the suspension within 7 days of your arrest, and the hearing examiner decides in your favor.

According to the DOL, “If you don't request a hearing or the hearing examiner doesn't decide in your favor, your license will be suspended for 90 days to 2 years, depending on prior offenses and the severity of the incident. Your suspension will begin 30 days from the date of your arrest.” If the court convicts you of a DUI, your driver's license will be suspended between 90 days and 4 years, depending on prior offenses and the severity of the incident. The suspension will begin 45 days after the DOL receives notice from the court that you were convicted.

Avoiding Further Suspension

You can avoid further suspension of your driver license if you meet and the DOL receives the following requirements:

  • A paid fee

  • Ignition interlock installation

  • Alcohol assessment and treatment report requirements compliance

  • Financial responsibility compliance

You can also avoid further suspension if you have full credit for time served for the same incident.
